Configure Split Rules

Split shift and clopening rules enforce labor policies by ensuring employees receive required rest time between shifts. When a schedule does not meet these requirements, Restaurant365 applies a penalty earning to the employee’s pay based on the configured rule.

Use these rules to support local labor laws, internal scheduling standards, and consistent payroll calculations.

Security

Users with the following permission will be able to create split rules:

  • Labor → Labor Rules → Split Rules → Create Split Rules

Users with the following permission will be able to edit split rules:

  • Labor → Labor Rules → Split Rules → Edit Split Rules

These permissions can be added to custom user roles or individual users. The Permission Access report can be used to determine which user roles or users already have these permissions assigned. For more information, see User Setup and Security.


Open an Split rule

  1. Select Admin from the left navigation rail.

  2. Expand Workforce.

  3. Select Labor rules.

  4. Select the rule to open its record.

Tip:

Find the rule Type in the Type column. In this example, Break type is selected.


Change locations assigned to a split rule

A split rule applies only to the locations selected in Locations. Locations not selected do not use the rule.

Follow these steps when a location opens, closes, or moves to a different rule:

1) Select the dropdown arrow by Locations.

An overtime rule applies only to the locations selected in "Locations". Locations not selected do not use this rule.

2) Check additional locations and/or remove locations.

3) Click Save.


Set the minimum wage

Follow these steps to set the minimum wage used as a baseline rate for penalty calculations:

1) Navigate to the Minimum Wage section.

2) Enter a minimum wage amount.

3) Click Save.


Set up a split shift rule

Follow these steps to configure a split shift rule that applies a penalty when an employee works two shifts in the same day and the break between those shifts exceeds the defined minimum minutes:

1) Navigate to the Split shift section and check, ‘Use split shift rule.’

2) Enter Split minutes.

In Split minutes, enter the minimum number of minutes the break between two shifts must exceed to trigger a penalty.

Tip: Breaks equal to this value do not trigger a split shift penalty.

3) Enter Second shift minimum minutes.

In Second shift minimum minutes, enter the minimum length the second shift must be for the penalty to apply.

If the second shift is shorter than this value, no penalty is applied.

4) Enter Penalty minutes.

In Penalty minutes, enter the number of minutes that will be paid as the split shift penalty.

5) Select the Penalty rate from the dropdown menu.

In Penalty rate, select the rate at which the penalty minutes will be paid. Options include: Job wage, Minimum wage, and Regular rate FLSA.

6) Click Save.


Configure a fixed penalty clopening rule

A fixed penalty clopening rule applies a flat dollar penalty when an employee does not receive the required rest time between a closing shift and the next-day opening shift. The system adds one penalty earning to the employee’s pay. The penalty amount does not change based on shift length or rest time missed.

Follow these steps to configure a fixed penalty clopening rule:

1) Navigate to the Clopening section and check, ‘Use clopening rule.’

The rule only applies to consecutive-day close-to-open shifts.

2) Enter Minimum rest hours.

In Minimum rest hours, enter the required rest time between a close shift and the next-day open shift.

If the actual rest period is less than this value, a penalty is triggered.

3) Select Fixed penalty amount.

4) Enter the dollar penalty amount.

This amount is applied once per violation and does not vary by shift length.

5) Click Save.


Configure an Entire second shift clopening rule

An entire second shift clopening rule pays the employee for the full length of the opening shift when the required rest time between shifts is not met. The penalty is based on the second shift length and the selected penalty rate.

Follow these steps to configure an entire second shift clopening rule.

1) Navigate to the Split shift section and check, ‘Use clopening rule.’

The rule only applies to consecutive-day close-to-open shifts.

2) Enter Minimum rest hours.

In Minimum rest hours, enter the required rest time between a close shift and the next-day open shift.

Note: The penalty is calculated only when the minimum rest period is not met.

3) Select Entire second shift.

4) Enter the Penalty rate multiplier.

If the second shift is 8 hours and the multiplier is 1.0 → employee is paid 8 penalty hours.

5) Select the Penalty rate from the dropdown menu.

Options include: Job wage, Minimum wage, and Regular rate FLSA.

Note: The full second shift is paid regardless of the size of the rest shortfall.

6) Click Save.


Overlapping time clopening rule

An overlapping time clopening rule pays the employee only for the required rest time that was missed between a closing shift and the next-day opening shift. The penalty is based on the difference between the required rest hours and the actual rest period, using the selected penalty rate.

Follow these steps to configure an overlapping time clopening rule:

1) Navigate to the Split shift section and check, ‘Use clopening rule.’

Note: The rule only applies to consecutive-day close-to-open shifts

2) Enter Minimum rest hours.

In Minimum rest hours, enter the required rest time between a close shift and the next-day open shift.

Note: The penalty is calculated only when the minimum rest period is not met.

3) Select Overlapping time.

Note: The penalty equals the difference between required rest and actual rest.

4) Enter Penalty rate multiplier.

5) Select the Penalty rate from the dropdown menu.

Options include: Job wage, Minimum wage, and Regular rate FLSA.

Note: Smaller rest shortfalls result in smaller penalty amounts.

6) Click Save.
